Terms & Services

Effective date: January 1, 2026

These Terms and Services (“Terms”) govern your access to the naughtystreams.com website, patient portal interfaces linked from this site, membership programs marketed as Health Care Card plans, and related digital communication channels operated by NStream Healthcare (“NStream,” “we,” “us,” or “our”). By accessing the website, submitting a form, enrolling in a plan, or receiving care coordinated through NStream, you agree to these Terms. If you do not agree, do not use our services.

1. Nature of Services

NStream provides outpatient medical services, preventive health programs, telehealth consultations where clinically appropriate, care navigation, and educational content. Website content—including blog articles, FAQs, and downloadable materials—is offered for general information and does not create a physician–patient relationship until you complete intake, verify identity as required, and are accepted as a patient by a licensed clinician.

Nothing on this website constitutes emergency medical instruction. If you believe you have a medical emergency, contact local emergency services immediately. Do not rely on email forms or non-urgent scheduling channels for time-sensitive symptoms.

2. Eligibility and Account Responsibility

You must provide accurate, complete information when registering, scheduling, or communicating with us. You are responsible for maintaining the confidentiality of portal credentials and for all activity under your account. Notify us promptly at care@naughtystreams.com if you suspect unauthorized access. We may suspend accounts that appear compromised or associated with fraudulent activity.

Parents and legal guardians may request care for minors they are authorized to represent. By submitting information on behalf of another person, you affirm that you have legal authority to do so and consent to treatment and data processing as described in our Privacy Policy.

3. Appointments, Cancellations, and Telehealth

Appointment requests submitted online are not confirmed until you receive written confirmation with date, time, clinician name, and location or telehealth link. We reserve reasonable slots for urgent visits and may propose alternative providers when your preferred clinician is unavailable.

Please cancel or reschedule at least twenty-four hours before a non-urgent visit when possible. Repeated late cancellations or no-shows may result in scheduling restrictions or fees disclosed at enrollment or checkout. Telehealth requires compatible devices, stable internet, and a private setting; you agree not to record sessions without explicit written consent from NStream and the clinician.

4. Membership and Health Care Card Plans

Membership tiers described on the Pricing Plan page outline bundled services, discounts, and access features. Plans are not a substitute for comprehensive insurance products unless explicitly stated in a separate written agreement. Benefits renew monthly or annually according to your selection; prices may change with thirty days’ notice to active members.

Certain services— including elective procedures, experimental therapies, out-of-network referrals, and prescriptions not on formulary—may incur additional charges. Waiting periods may apply to specific benefits as disclosed during enrollment. Refund policies for unused portions of prepaid terms are handled according to the enrollment agreement and applicable consumer regulations.

5. Payment and Billing

You agree to pay fees for services rendered, membership dues, and applicable copayments at or before the time of service unless other arrangements are approved in writing. We may use third-party payment processors; their terms apply to card transactions. Itemized statements are available through the patient portal or upon request via email.

If you dispute a charge, contact us within sixty days of the statement date with supporting details. We will investigate in good faith and respond with findings and any adjustments owed. Failure to resolve payment may result in suspension of non-urgent scheduling until the balance is addressed, subject to clinical ethics and applicable law regarding continued emergency care.

6. Intellectual Property

The NStream logo, website design, text, graphics, and proprietary care pathways are protected by copyright and trademark law. You may view and print pages for personal, non-commercial use. You may not scrape, mirror, frame, or redistribute content without prior written permission. Feedback you provide may be used to improve services without obligation to compensate you.

7. Acceptable Use of Digital Channels

You agree not to misuse the website or portal: no uploading malware, attempting unauthorized access, harassing staff, impersonating others, or submitting false clinical information. We may monitor aggregate usage for security and performance. Violations may lead to termination of access and referral to law enforcement where warranted.

8. Third-Party Links and Tools

Our site may link to external laboratories, pharmacies, educational resources, or social platforms. We do not control third-party content or privacy practices. Your use of external sites is at your own risk and subject to their terms. Integration with wearable devices or health apps occurs only when you opt in and authorize data sharing.

9. Disclaimer of Warranties

Services are provided on an “as is” and “as available” basis to the fullest extent permitted by law. While we strive for accurate scheduling, secure systems, and clinically sound content, we disclaim warranties of uninterrupted access, error-free software, or specific health outcomes. Clinical decisions are made individually by licensed professionals based on evaluation—not on website content alone.

10. Limitation of Liability

To the maximum extent permitted by law, NStream and its affiliates, directors, employees, and contractors shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or services, including lost profits, data loss, or business interruption. Our aggregate liability for direct damages related to digital services shall not exceed the greater of one hundred dollars or the amount you paid to NStream for membership in the twelve months preceding the claim, except where liability cannot be limited by law.

11. Indemnification

You agree to indemnify and hold harmless NStream from claims arising out of your misuse of the website, violation of these Terms, infringement of third-party rights, or submission of inaccurate information that causes harm, except to the extent caused by our gross negligence or willful misconduct.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which NStream’s principal administrative operations are established, without regard to conflict-of-law rules. Parties will attempt in good faith to resolve disputes through informal negotiation via care@naughtystreams.com before pursuing formal proceedings. Where permitted, you and NStream agree that exclusive venue for litigation shall be courts located in that jurisdiction, unless consumer protection laws grant you non-waivable rights to bring claims elsewhere.

13. Changes to Terms

We may update these Terms to reflect regulatory changes, new services, or security requirements. Material changes will be posted on this page with a revised effective date. Continued use after changes constitutes acceptance. For enrolled members, significant adverse changes may require renewed consent where mandated by law.

14. Clinical Records and Release

Medical records created during your care belong to NStream as custodian, while you retain rights of access described in our Privacy Policy and applicable health laws. Requests for copies may require identity verification and reasonable reproduction fees where permitted. Amendments to records follow clinical review; disagreements may be documented as patient statements appended to the chart.

15. Research and Quality Improvement

We may use de-identified clinical data for internal quality metrics, outcomes research, and training. Participation in prospective research studies requires separate informed consent. You may opt out of non-essential research outreach without affecting routine care, except where a study intervention is the treatment plan you elect.

16. Communications Consent

By providing email or mobile contact information, you consent to receive transactional messages about appointments, billing, and portal security. Marketing messages require explicit opt-in and include unsubscribe mechanisms. Standard carrier rates may apply to SMS where offered.

17. Severability and Entire Agreement

If any provision of these Terms is held invalid, remaining provisions remain in effect. These Terms, together with enrollment agreements, the Privacy Policy, and visit-specific consents, constitute the entire agreement regarding website and membership services unless superseded by a signed enterprise contract.
